Sources Of Indian Constitution

  • The article of Indian constitution was derived from the Government of India Act 1935
    many provisions were imported from other constitution of different countries.
    Some of them are:
     ➤Government of India Act 1935 - This act formed the blueprint of constitution of India
         with the federal system, office of Governor, emergency powers etc.
     ➤From Constitution Of USA- Independence of Judicial review, fundamental rights,
         Removal of supreme court and high court judges, Preamble and function of president,
         and vice president.
     ➤From Constitutions Of Britain:- Law making procedure, Rules of law, Single citizenship,
         Bicameral parliamentary system, office of CAG.
     ➤From constitutions Of Canada-  Federation with strong centres, To provide residuary
         powers of the centre, supreme court's advisory jurisdiction.
     ➤From Constitution Of Ireland:- Directive principles of state policy, methods of presidet
         -ial election, Nomination of members of Rajya Sabha by the president.
     ➤From Constitution Of Germany:- Provisions concerning the suspension of fundamental 
         rights during emergency.
     ➤From Constitution Of Australia:- Idea of the concurrent lists, Trade and commerce
         provisions.
     ➤From Constitutions Of South Africa:- Ammendment 2/3 rd majority in Parliament and 
         election of members of Rajya Sabha on the basis of proportional representation.
     ➤From Constitutions Of France:- Republican System, principles of Liberty, Equality
         and Fraternity.
     ➤From Contitution Of USSR:- Fundamental Duties, Idea of Justice in preamble.
